Terms of Service

These Terms of Service ("Terms") govern your use of Commonplace, operated at commonplace.study ("Service," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
Commonplace is a subscription-based theological research tool providing access to a curated library of Reformed and Puritan literature, AI-assisted search and synthesis, and document reading features. The library consists primarily of public domain texts from the 16th–20th centuries.
2. Accounts
You must provide a valid email address to register. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at info@commonplace.study if you suspect unauthorized access.
You must be at least 13 years old to create an account. By registering, you represent that you meet this requirement.
3. Subscriptions and Billing
Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a recurring monthly or annual basis, as selected at checkout. All payments are processed by Stripe.
Free trial. We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial expires.
Cancellation. You may cancel your subscription at any time through the billing portal accessible from your account settings. Cancellation takes effect at the end of your current billing period. We do not issue partial-month refunds.
Refunds. We offer refunds within 7 days of your initial purchase if you are unsatisfied with the Service. After 7 days, all charges are final. To request a refund, email info@commonplace.study.
Price changes. We may change subscription prices with at least 30 days' notice. Continued use after a price change takes effect constitutes acceptance of the new price.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You agree not to:
- Use the Service to reproduce or redistribute copyrighted content beyond fair use
- Attempt to reverse engineer, scrape, or systematically extract the library contents or AI outputs for use outside the Service
- Share your account credentials with others or allow multiple users to share a single account
- Use automated means (bots, scrapers) to access the Service without our written permission
- Upload content that is illegal, harmful, or that you do not have rights to share
- Attempt to compromise the security or integrity of our systems
5. User-Uploaded Content
You may upload documents to your private library. You retain ownership of any content you upload. By uploading content, you grant us a limited license to store and process it solely to provide the Service to you. We do not use your private uploads for any other purpose.
You represent that you have the right to upload any content you submit and that doing so does not infringe third-party rights. We reserve the right to remove content that violates these Terms or applicable law.
6. Library Content and AI Features
The public library consists of works in the public domain. We make no representation that all works in the library are free of third-party claims in every jurisdiction. AI-generated summaries and synthesis are provided for research assistance and are not guaranteed to be accurate, complete, or free of error. You are responsible for verifying any AI-generated content before relying on it for teaching, preaching, publication, or other purposes.
7. Intellectual Property
The Commonplace name, logo, interface, and software are our proprietary property. Nothing in these Terms transfers ownership of any intellectual property to you. You may not reproduce, copy, or distribute any portion of the Service or its software without our written permission.
8. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent or abusive behavior, or for any other reason with reasonable notice. Upon termination, your access to the Service will cease and your data will be handled as described in our Privacy Policy.
You may delete your account at any time by contacting info@commonplace.study.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, COMMONPLACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
11. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date above and, for material changes, notify you by email. Continued use of the Service after updated Terms are posted constitutes your acceptance.
13. Copyright Complaints (DMCA)
We respect intellectual property rights. If you believe that content available through the Service infringes your copyright, please send a notice describing the allegedly infringing material and your contact information to info@commonplace.study. We will review valid notices and remove infringing content as required by the Digital Millennium Copyright Act.
